BOARD OF ADJUSTMENT
PRELIMINARY MEETING MINUTES
FEBRUARY 10, 2010
Case 10-01

9:03 PM Board members present:  JGryval, DDineen, KOconnell, CPettigrew, LWhite.

Case 10-01:  Application for a hearing for a Special Exception III Article I 2.e (3)  from  Robert & CarolynTrosky, 7907 Pocahontas Ave West, West Tampa, Florida 33615.
 
JGryval clarified that he is not an abutter to property, but abutter to an abutter at the back of the property.  He spoke with Atty. Cronin about his sitting on this case.  Atty. Cronin asked if Chairman Gryval could sit fairly and without bias.  Chairman Gryval assured Atty. Cronin that he could.
Public portion of this hearing was opened at 9:05 pm.  JGryval stated based upon what we’ve already heard tonight about the width of driveway and how it was initially approved to extend to 50’ and whereas the driveway will not be made any longer, and with no further encroachment of wetland, I feel that the Special Exception needs a little more discussion.  Originally this property was approved for a single family subdivision and now we will listen to new owners/applicants proposal.  JGryval asked if anyone in general public have any questions. MBorden said that he had a copy of original meeting minutes and referenced to the 1/8/07 minutes.  (See attachment.)

DDineen asked if the contractor would explain to the Board as to what was done when the first driveway was installed …what measures were taken to prevent soil erosion, etc.   Scott Tucker, contractor, explained that erosion fabric was put in to protect wetlands.  He also explained that it took two days after the 2008 ice storm to clean up the damage before he started on the driveway.

KOconnell stated that the driveway wasn’t put in according to original plans. JGryval said to him it looked like the driveway was being put in appropriately as he was driving by it daily.   John Cronin stated that due to an inadvertent mistake that occurred during the initial installation by the contractor and when the newer, common driveway is constructed that this will be corrected. CPettigrew questioned, “is the area where common driveway is going in; will there be any reclamation of the wetlands that were encroached upon?”  DOhara said that a NHDES permit will be sent to the state and the error will be rectified.  JGryval said that it appears none of the common driveway for 2nd unit will impact wetlands.

9:13 pm public portion closed.  

CP motioned that the Board of Adjustment approve the applicants request for the use of the driveway as a common driveway for two residences as approved by the Planning Board. DDineen seconded the motion.  The vote was unanimous.

Fees collected for $50, check #833 written by Steve Carey for application fee.  The hearing closed at 9:17 pm.
