Case 08-6
After several meetings, the board reviewed and discussed all~available evidence presented in previous meetings for the~aforementioned case.~ The Board unanimously finds~along with the record, which clearly~notes that the Planning Boards fire suppression system requirement could be met without impacting the wetlands. This is~evidenced through the direct testimony to this board by the applicant himself when Mr. Mitchell~stated~that it was possible to place the suppression system elsewhere on the property.
This argument was further strengthened by the applicants engineer, Mr. Chamberlain during his testimony on August 18th when he was specifically asked if a cistern placed elsewhere would impact the wetlands, and replied “No.”
The Board unanimously finds that the facts stated in the original decisions stand, and that this latest request did not address any error the board had made in it’s original decisions,~furthermore did not~offer any new evidence that may change the opinion of the Board
