Meeting Minutes
September 16, 2008
The Zoning Board starts to gather after 7:30 p.m. with John, Roger, Loren, and Kevin in attendance when Craig arrives at approximately 8:15, and John opens the meeting with a full board.
John reminds the board that they’re here to decide on whether to grant a request for a re-hearing of case 08-6 as requested by Eugene Mitchell of 418 Sawmill Road, Greenfield. Kevin gives the board copies of the application for rehearing and also preliminary minutes from the last meeting.
The board decides to read and approve the minutes from the last meeting first, before going on to discussion of the rehearing request.
The board notes the following corrections by line number;
113 “need” to “needs”
114 “discussion” to “decision”
64 remove “the”
65 “affect” to “affects”
91 remove “shows”
Roger motions to accept minutes as corrected. Loren seconds, motion carries.
The board goes onto the issue of the rehearing request, and decides to reply to the points of appeal individually.
1.a. The board unanimously finds that the fire pond concerns where discussed during the public session of the hearing.
1.b. The board unanimously finds that there was no misinterpretation of the ordinance.
1.c The board unanimously finds that the Planning board process may, and often does occur before ZBA involvement; so the ZBA sees no issue.
2. The board unanimously finds that the redesign does not negate concerns raised at the original hearing.
3. The board unanimously finds and acknowledges that a fire suppression water supply was a Planning board requirement. However, given the wetlands encroachment must be granted by the ZBA, it would be erroneous to assume that “ it would be readily approved.”
4. The board unanimously finds that the Conservation Commission did express their concerns during a public hearing. The board respected their right to be heard as required by law, and took their opinion under advisement.
5. The ZBA strongly disagrees with this statement and wants to make it clear that a special exception is required in this case. The board also felt it important to state that any question of interpretation of a zoning ordinance brought forth within the town by other officials or boards, must be brought to the Zoning board, as they are the board who must hear any appeal on the subject.
After the discussion and voting of the items, Craig motions to deny the appeal for rehearing, seconded by Loren, motion carries.
John suggests the board copy the Selectmen, Con-Com, CEO and Planning Board with the decision.
Roger motions to end meeting at 9:30, seconded by Loren, motion carries.
