Case 08-6
The board met on September16, 2008 to decide whether to grant a re-hearing of case 08-6 as motioned by Mr. Gene Mitchell, the board finds the following to items brought forth:
1.a. The fire pond concerns where discussed during the public session of the hearing.
1.b. The board feels no misinterpretation of the ordinance occurred.
1.c Planning board process may occur before ZBA involvement; therefore the ZBA sees no issue.
2. The ZBA feels the redesign does not negate concerns raised at the original hearing.
3. The ZBA acknowledges that a fire suppression water supply is a Planning board requirement. However, given the wetlands encroachment must be granted by the ZBA, it would be erroneous to assume that “ it would be readily approved.”
4. The Conservation Commission did express their concerns regarding the wetlands at a public hearing.
5. The ZBA strongly disagrees with this statement and wants to make it clear that a special exception is required in this case.
Therefore, based on the above discussed the motion for re-hearing is DENIED.
