Notice Of Decision
Zoning Board of Adjustment
Greenfield, NH 03047
Case 07-4
You are hereby notified that the Zoning Board of Adjustment has DENIED an appeal submitted by Charles Roberson of 145 Zephyr Lake Road, Greenfield for the following;
Appeal for Variance from section III.C.3 of the Greenfield Zoning Ordinance; Setback requirement. for property identified as lot S1-25, located at 145 Zephyr Lake Road.
The Boards findings were as follows:
1. The proposed use would not diminish surrounding property values.
2. Granting the variance would be of benefit to the public interest.
3. Denial of the variance would not result in unnecessary hardship to the owner as the conditions of the property are not unique to the property in its setting, but the location of the property.
4. Granting the variance would do substantial justice.
5. The proposed use is not contrary to the spirit of the ordinance as it would require that the frontage requirement be violated.
For a variance to be legally granted, all five of the preceding conditions must be met.
