Meeting Minutes
February 13, 2007
The board meeting opens at 7:30, with members John Gryval, Kevin O’Connell, Loren White, Craig Pettigrew, and Dan Dineen seated.
John opens at the public hearing at 8:00 for case 07-3 Daniel and Robert Pratt of Temple, NH for property located on New Boston Road and Blanchard Hill Road, map R-7, lot 21, for a special exception from restrictions of the Wetland Conservation District; article III section I.2.d.1.
John explains to the board and the applicant that he lives near the property, and asks both if they object to him sitting on the case.
Both the board and the applicant reply, no.
John asks of notification, and Kevin replies that proper notification was done, and John explains the proceedings process to the public.
John asks the applicant to present his case, and Mr. Pratt states presentation will be by his legal council, Atty. Cronin, and surveyor, David O’Hara.
John asks them to proceed.
Atty. Cronin explains that this is a subdivision plan that has been before the Planning Board for a number of years, and has had several different configurations. What they are looking for tonight is a wetlands buffer crossing of a sixteen acre lot along New Boston road, and that the crossing will only be disturbing the buffer, not the wetlands. They had thought of creating two lots from the sixteen-acre lot and putting in a common driveway, but tonight they are only looking for a crossing for a single driveway, any other application would be up to a future owner.
John asks Karen Day of the Conservation Commission if they have been involved in this. Karen replies no, but she knows where it is.
Dan states it looks like exactly fifty feet between the sections of wetlands where the driveway is shown.
David O’Hara replies, “Pretty close”.
John asks what’s the size of the driveway.
Mr. O’Hara replies “Twelve feet.”
Mr. O’Hara replies that they’d look at that, but right now the flow goes two different directions around the buffer.
John asks the length of the disturbance, O’Hara replies seventy-five feet, five thousand nine hundred square feet of disturbance.
Craig talks of the width of the buffer and asks how much of the buffer would be left, John replies fifteen feet on both sides.
Craig states they’re not changing the topography much.
Mr. O’Hara replies it was an old logging road.
John asks Karen what the Con-Com’s view. Karen replies it seems the proposal is the least impact on the wetlands.
John asks if anyone has any questions, and receives no reply.
Craig motion to close the public portion of the hearing at 8:25, motion seconded and passed.
Board discusses the plans.
Motion made by Craig to approve the appeal submitted by Daniel and Robert Pratt for proposed lot R-7, lot 21.2, for a special exception from restrictions of the Wetland Conservation District; article III section I.2.d.1. under the following conditions;
1. Special exception is for single residential driveway.
2. Driveway shall have a maximum width of (12) twelve feet, and shall be located as to minimize the impact of the wetland buffers on both sides.
Motion seconded by Dan, and motion carries with four yeas, with one abstention from John.
Motion made and seconded to close meeting, motion carries.
