Meeting Minutes
January 6, 2007
Board convenes site walk for case 07-1 at the location on Cornwell Road at 8:00 am with Chairman Gryval, members Phelps, O’Connell, and alternate White present. The Board asks Mr. Todd some questions, but does not discuss the case with each other. Also in attendance is DPW head Duffy (Wyatt) Fox, abutter Mike Borden, and Adele Hale. After the site walk John tells those present in the rain that the board will be reconvening back in the town office, where it’s a bit drier.
After all are present at the town meeting room, John makes a statement that during the site walk the board talked with DPW head about road drainage and a possible swale and John assured Mr. Fox that drainage will be to the DPW head’s approval, then John reopened public hearing 07-1 at 9:05 am.
John recaps what the board observed during the site walk, that flags were placed, and seemed to be a true depiction of the wetlands. John notes that Dan Dineen was not present at the site walk and is not now present so there are only four board members present. John then asks Adele Hale if she’d like to wait for a full board, Adele replies “Proceed.”
Roger states he heard comments on how wet the area was, but didn’t find it particularly wet, at least not on that one spot.
Loren states that he agrees with Roger, he thought it’d be much wetter.
Roger states he can’t see where there’s much of a problem.
John states it looks like obvious upland.
Loren “The grade sheds to the road with a culvert under the road. Is there enough upland?”
Mr. Todd;” Well over the two acres of upland. “
Loren;” Two acres of five?”
Mr. Todd replies 3.3 of upland, and that it’s his understanding that upland within the buffer is counted in upland calculations.
John talks of the driveway width within two sections of wetlands, it’s distance to the wetlands, and how much of the buffer would be disturbed at its most constrictive point.
Kevin talks of putting on the plat or deed, restrictions of the driveway, the house location and envelope, to insure that the build out of the property takes place as required by the Special Exception granted by the ZBA.
John agrees, along with drainage of the road.
Motion made by Roger to grant appeal for a special exception from restrictions of the Wetland Conservation District; article III section I.2.d.1, submitted by Clare Belmore Heirs, P.O. Box 272, Greenfield, NH, under the following conditions;
1. D.P.W. approval of the driveway cut and all necessary drainage.
2. The driveway must be located as to minimize buffer impact and the least amount of remaining undisturbed wetlands buffer shall be ten feet wide on both sides.
3. Ground flags must be placed delineating the reduced wetland buffer of ten feet on both sides before any ground disturbance or clearing, and be subject to the inspection of the building inspector.
4. Any deviation from the above requires a hearing before the Zoning Board.
Loren seconds the motion.
John asks for any discussion on the motion.
Hearing John calls for the vote.
The board votes four yea, no nea or abstentions.
