Meeting Minutes
January 2, 2007

Board convenes at 7:30pm with Chairman Gryval, members Phelps, O’Connell, Dineen, and alternate White present.

At 8:00 pm John Gryval opens hearing 07-1 for Clare Belmore Heirs, P.O. Box 272, Greenfield, NH for property located on Cornwell Road, map R-6, lot 21.1, for a special exception from restrictions of the Wetland Conservation District; article III section I.2.d.1.

John asks if proper notification was performed, Kevin replies notification was sent to abutters, posted in the town offices and post office, and the hearing was properly noticed in the Monadnock Ledger-transcript.

John asks Adele Gagnon-Hale to proceed, she indicates Mr. Robert Todd; Todd Land Use Consultants, New Boston, NH will be presenting.

Mr. Todd describes where the property is, the general conditions of the property, and that the appeal is for a driveway on a proposed lot, not yet created.
Mr. Todd states only a small portion of the frontage is not in wetland, and that they want to locate the building area at the back portion of the land in an area that is less restrictive, and that they’ll need to disturb 425 square feet of the buffer to site the driveway.

Mr. Todd states the land is relatively flat with a slope of one to three percent, and soil type is scurry, rated very low erosion soil, well drained.

Mr. Todd also suggest the driveway not be paved as that would make it impermeable. He’d rather hardpack, with crowning for sheet flow.

Mr. Todd states at this point he feels he’s made he’s made a case to use the upland, the driveway would be minimal impact, and it’s the only access to the five acre northern lot. Mr. Todd also states this would not require a DES dredge and fill permit.

John ask how large the property is.
Mr. Todd replies thirty acres, and shows the board the overall plot.

John: “So it’s currently one parcel before the Planning Board.
Mr. Todd: Actually it’s twenty-seven acres that they plan to subdivide.

John asks what the frontage is.
Mr. Todd replies 420 feet, almost all wetland.

Roger asks if any wetland stakes have been placed.
Mr. Todd replies not yet, but suggest they be placed before construction.

Dan asks what the finished height of the driveway will be.
Mr. Todd replies two feet.

John asks for the total length, Mr. Todd replies 270 feet.

John asks; “Where the home site is done it’ll meet the setback?’
Mr. Todd: “ Yes, but just the draft location, it could go elsewhere.”

John asks of need for culvert on Cornwell Road.
Mr. Todd replies he hasn’t yet talked to the road agent, there might be.

John says,” It seems like we’re getting well into encroachment”
Mr. Todd states the whole 25-foot buffer.

John asks if anyone has any more questions.
Roger replies; “no questions, maybe we should take a look at it.”

John asks Dan if he has any, Dan replies “no.”

John asks if any input from the forum.

Conrad Dumas, an abutter, replies that he feels the board may want to look at how much water goes through there.

Mike Borden, an abutter, states he’s looked at the lot, and doesn’t think there’s much flow.

Mr. Todd describes the wetlands as forest wetland, and what that entails.

John asks the board what they think.
Roger replies that he thinks we should take a look.

John recaps the case and Mr. Todd adds that there are no zoning issues on the rest of the proposed lots,

John states Roger and Dan feel we should look at this, and explains the forum that the board will recess the public hearing for the site walk.

Roger makes the motion to suspend the hearing until a future date, seconded by Dan. John asks for the vote and the motion is voted in the affirmative, unanimously.


The Board schedules the site walk for 8:00 am on the following Saturday, January 6, 2007. with the continuation of the public hearing to follow at the town offices.

Mr. Todd states he’ll be there and will supply a plan with the wetlands stamp.

John then brings the board attention to a letter from Landmark’s attorney, the McLane firm, requesting another appeal from the Planning board decision of late.

Kevin asks the board if he should step down from this.

Dan reads 673:14 aloud, and the board discusses the RSA as it pertains to this case. After the discussion John asks for a vote from the board if they feel Kevin should stay seated. Motioned seconded, and the Board votes in favor with 4 yes, 0 no, and 1 abstention from Kevin.

John states his discomfort with the request for Kevin’s recusal.

Dan reads aloud 673.7, and how it pertains to a member of the Planning Board being on the Zoning Board, and that he sees no problem with it.

Dan also reads aloud 677.2, and how rehearings should not be granted lightly.
The Board discussed the reasons requested for rehearing and enumerated them.

Roger makes a motion to deny rehearing due to lack of any new evidence brought forward in the appeal, and that the board didn’t err in the original decision.

Motion seconded, John calls the vote, and the Board votes to deny the rehearing   with 4 yes, 0 no, and 1 abstention from Kevin.

John asks Kevin to send a copy of the letter to town council for an opinion.

Motion made and seconded to close the meeting at 9:35
