Case 06-5

You are hereby notified that in response to your Appeal from Administrative Decision of the Planning Board for case # PB-SUB-06-12-06; Motion for Rehearing, and the Zoning Boards’ decision to grant a hearing to answer questions with regards to reason #3.

“The Planning Board feels that the application’s dwelling count of 32 is much greater than what is allowed in the Open Space Development Ordinance.”

The Zoning Board of Adjustment has found the following.
        
1.      Duplex units are allowed and counted as two dwelling units on two lots.
2.      The seventy five foot buffer around wetlands for the septic system has to be deducted in the density calculations
3.      Allowance of a twenty percent density bonus is solely at the discretion of the Planning Board.

As stated previously, the Board decided not to grant a Hearing for reasons #1,2, and 5, as these do not present a separate issue of zoning ordinance interpretation.
