Meeting Minutes
September 5, 2006
Board convenes at 7:30pm with Chairman Gryval, members Phelps, O’Connell, Dineen, and alternates Sanford and White present. Board goes over minutes of August 22, meeting, and accepts the minutes with minor typographical corrections noted..
John Gryval opens case 06-6; Mathewson Real Estate Holdings, LLC of Hancock, NH for property located on Muzzey Hill Road, lot R1-2, for a special exception from Greenfield Zoning Ordinance, article III section I-2; wetland conservation district. Dale Sanford recuses himself from the hearing.
John asks if proper notification was sent. Kevin replies it was.
John presents Attorney Little representing Matthewson with an invoice for the hearing. Kevin explains that the billing is not yet accurate, as he’s received no invoice from the Ledger. John makes the suggestion that we wait on the invoice and send an accurate one when we get the information we need, Attorney Little agrees to pay it when he receives it.
Mr. Mathewson tells the board that Attorney Little will be representing tonight and he and Surveyor Dennis McKenney will be here to assist.
John asks Attorney Little to present his case.
Little shows the board the plat for the property, explains that they’re looking for special exceptions to perform wetlands buffer incursions for two driveways on the property. One of the crossings is currently a woods road, which they’d like to get approval for a common driveway access to the two large lots. The second is for an alternate single driveway access into the one the two large lots. The third lot in the subdivision plat doesn’t need a special exception and isn’t part of this application. Attorney Little further states that they’ve consulted with their surveyors at Meridian and Meridian feels that the State would rather have two small incursions instead of one larger incursion. Attorney Little shows the board Meridians wetlands plan, and states that under the Zoning Ordinance his client meets the
requirement to grant a special exception.
John Gryval goes over the plans with Attorney. Little.
Mr. Mathewson states the reason they went with the back lot configuration is so the back lot can’t be subdivided.
John asks, “ Wouldn’t having two driveways make it more valuable?”
Mr. Mathewson explains that they were before the Planning Board and were hoping they could choke down the width of the common driveway to avoid wetlands, but when they found the Planning Board couldn’t waive the driveway width they decided to go with two driveways.
John states we’re here to determine minimal impact.
Mr. Mathewson shows the Board photos of the location and site of the woods road and states they’re trying to minimize impact.
John asks what about the four-acre lot in front.
Mathewson explains lot to John.
John asks the only abutter present Stephen Klonel, if he’s in favor of Mathewson’s plan.
Mr. Klonel replies that he is.
Mr. Mathewson explains the culvert currently in place in the woods road crossing.
Discussion of the culvert ensues.
Mr. Klonel states he’d rather see the common driveway, as that would mean less woos cutting.
Kevin asks where the wetland stamp is on the plat.
Attorney Little produces a plat with the stamp.
Dan Dineen states the board has to determine the minimum impact. What is the impact to the surrounding area and who do we get that from.
Attorney. Little talks of productive use of the land, accessing the land, and states he believes there’s very little impact.
Dan replies that that doesn’t answer the question of what the impact is, and he needs more information, that he’s not a soil scientist or a biologist.
Mr. Klonel states looking over the whole project, he’d more concerned with the tree cutting.
John asks if anyone would like to go on a site walk.
Roger says, yes. Dan says’ it wouldn’t hurt.
John agrees and asks how we should do it.
Roger motions to adjourn the public hearing, keeping the public session open, to perform a site walk of the property. Motion carries unanimously.
Board sets the date as Thursday Sept 7 at 6:00 pm with the hearing to follow at the town offices.
Board adjourns the hearing and meeting at 9:20 pm
