Meeting Minutes
March 29, 2005

Board convenes at 7:30 to conduct business session.
Sitting on the board is John Gryval, Kevin O’Connell, Dale Sanford, Craig Pettigrew, and chairing the meeting, Dan Dineen.

Board passes out sheet so that audience can sign in if they wish to speak to the issues.

At 8:00 pm Dan opens hearing 05-5. Application by Daniel J. Pratt, 11 Stone Lane, Temple, NH, for a Special Exception from the 25 foot wetlands buffer.

Dan explains the proceedings, and asks if public noticing was followed. Kevin replies yes, that all but two abutter confirmation slips were received, and that the meeting was posted in two locations.

Dan presents Mr. Pratts council with an invoice for $192.00.  Council replies he hasn’t the fee. The Board decides to forgo the collection of the fee for tonight upon the word of council that the fee will be paid at the earliest possible convenience.
Council agrees.

Council states that Mr. Pratt’s brother Robert is sitting in place of the applicant due to illness.

Dan asks council to present his case.

Dan asks if theR7-21.1 lot plat shows the wetland as they are now, or after construction of the driveway.
Council replies “after.”

Board discusses water flow off knoll, and its direction.
Council states driveway will flow into road.

John asks if the lots are there now.
Council replies this is a proposed development that was referred to the ZBA by the planning board for a special exception because an exception was required for one of the lots for the wetlands buffer crossing.

Council further states that he feels that granting the exception is warranted as to allow productive use of the land.

Dan asks what happens to the water at that location.
The Board and Council try to determine the flow.

Dan asks if there’s any supporting evidence from the audience.
No response.
Dan asks if and opposing, no response.

Motion to close public portion of hearing made, seconded, and voted in the affirmative.

John asks for Planning Board comment. Dan reads Planning Board comment.

Board discusses filling in the buffer.

Kevin reminds that the plat is as a proposed subdivision, and that the current lot has access.

John states he doesn’t feel this is within the spirit of the ordinance, and reads the ordinance aloud.  He feels that the ordinance should be adhered to, and that not granting the exception would not prevent productive use of the land.

Board further discusses.

John makes motion made to deny, motion seconded. Board votes, motion to deny unanimously carried at 8:30 pm.

Council asks how long he has to appeal decision. John explains the procedure and his right under state law.

Board decides the wording of the denial.

Minutes from the March 22, 2005 meeting were read.
Typos noted for correction, motion made to accept as corrected. Motion seconded and passed.

Motion made to open case 05-4b, Steven J Mayo, Merrimack, NH, application for variance. Motion seconded and passed.

Motion made to vacate decision on case 05-4a, and close hearing without further action on case 05-4b, in light of finding that, upon recount, the steps slopes ordinance ballot question failed to pass.

Motion seconded and passed.

Motion made to close meeting made at 9:10, motion seconded and passed.
