Meeting Minutes
February 22, 2005

Board convenes at 7:30 to conduct business session.
Sitting on the board is John Gryval, Kevin O’Connell, Loren White, and Craig Pettigrew. Board reads mail and discusses letter from town’s attorney concerning Horne case.

Board discovers that Dan Dineen cannot make meeting until 9:00 pm due to home emergency.

John asks applicants if they’re willing to wait, or do they want to reschedule.

Applicant state’s they’ll wait

The board reads minutes from case 05-1
Motion made to accept minutes, motion seconded and passed.

Dan Dineen arrives at 9:20 and John opens case 05-2

Case 05-2

Ann Bellamy, 76 Rocky Pond Road, Hollis, NH, for an Equitable Waiver of Dimensional Requirement.  For a structure located at 380 New Boston Road, Greenfield, NH

John explains the procedure to the applicant and presents an invoice for $190.67.

Attorney Andrew Sullivan, representing Ann Bellamy, goes over his presentation as outlined in the application.

Kevin asks why attorney stated house was sited well within setback, when it was actually placed almost directly on the setback line.

Attorney stated they were within setback.

John asks why driveway was moved.

Applicant: I believe it was the slope.
Attorney: I don’t really have the answer.

John asks again, I trying to clarify, why was the driveway moved?
Attorney: I’m not trying to fix blame, the town and contractor made a mistake.
John: Were the footings inspected?
Attorney: Mistake was found after.

Peter Hopkins explains that he suggest to builders that they get a certified plot plan after the footing are put in, if they don’t, it’s their responsibility.  When he inspects the footings for structure, not precise location, but the certified plot is require before an Occupancy Permit can be issued.  

The Applicant states that Southwell, the modular home contractor, didn’t get the Certified Plan before placing the house, and since Peter didn’t object after he inspected the foundation, he assumed it was OK.

John goes over Equitable Waiver requirements.

Dan asks for a timeline.

Applicant:
Oct 14, 2005 Building permit pulled.
Site work, foundation poured.
November 4, 2005 house placed.

Board asks Carolyn Woodbury, the only abutter present if she has any comment,
She states she has not objection.

John continues to go through waiver list.

Peter Hopkins states to the board he feels it meets the waiver requirements.

Board closes public comment portion at 10:10

Kevin questions if it’s a mistake in re-locating the house or negligence of the builder since he knew he was so close to the setback.
John; would that constitute failure to inquire?

The board discusses equitable waiver.
Craig motions to grant equitable waiver, Loren seconds. No objections, moved to vote.

Board votes to grant equitable waiver, three yes, one no, one abstained.

Motion to adjourned, seconded, voted at 10:30
