January 18, 2005
Meeting opens at 7:00
Board discusses future issues with CO Peter Hopkins.
7:30; John Gryval opens case 05-1: Jeff Balcom, 148 Swamp Road, Greenfield, NH, for a variance from Section III, G paragraph 4 of the Greenfield Zoning Ordinance.
In attendance, are John Gryval, Dale Sanford, Kevin O’Connell, and Daniel Dineen, and Craig Pettigrew.
John explains the process to the applicant.
John reads invoice for $188.74 to Mr. Balcom
Kevin receives check #4878 for above amount form Mr. Balcom.
John notes that the property is not owned by Mr. Balcom and asks if the owner is present.
Mr. Balcom states that the owner is his father and he has a letter stating that he can speak to the issue.
John goes over the letter, making note that it isn’t notarized, applicant states he didn’t have enough time.
Dan questions if we can accept the note.
Craig suggests any decision we make would be pending legal notarization.
John asks about planning board comments; Kevin states he brought it up after the meeting.
John asks the applicant who sent him to the ZBA.
Mr. Balcom said someone at the Planning board to him to go to the ZBA because it was a change of use, but didn’t know whom.
John explains the process to the applicant again.
Mr. Balcom states he was told by Peter Hopkins to contact the Planning Board, and the Planning Board told him to contact the ZBA.
Craig asks if Mr. Balcom is looking to change the zoning to Commercial.
John questions whether we should accept the application, as there has been no denial to appeal.
Kevin explains to Mr. Balcom that neither the Planning Board nor the ZBA can change the towns’ zoning restrictions, only a vote a town meeting can.
John reads 674:33 and states he feels the board cant here this as no denial has been issued.
Peter states that he told Mr. Balcom he can’t grant a permit for a storage barn for a business in the rural/agricultural zone. He’s going to have to get a variance.
Resident George Rainer questions the business being currently in a residential area.
The board discusses whether they should be hearing this case, as no site plan has been received.
Motion made to deny application acceptance and forward to the Planning Board without prejudice for site plan review.
Motion seconded and accepted.
John explains case to applicant directing him to get in touch with Bob Marshall of the Planning Board.
Board reads minutes from 9-14-04 meeting, cases 04-3 and 04-4.
Motion made to accept as read, seconded and passed.
