Members present:  BMarshall, GMorris.  MSteere, MBorden, JFletcher, KO’Connell.

7:02 pm Start of Meeting
MSteere reads the minutes from the December 14, 2009 meeting.

Changes:
Line 36 change “for COE” to “from CEO”

MSteere moves that the minutes be accepted as amended, MBorden seconds, no discussion, KO’Connell abstains, the motion passes

7:09 PCC for Randy Loubier, Tax Map R9 Lot 29
RLoubier discusses with the PB his thoughts concerning the property he is considering purchasing.  There is much discussion concerning this piece of property.  Access is from a class six road located in Lyndeborough, NH.

1.      Selectmen’s Meeting Minutes dated December 10, 2009
2.      Application for Subdivision to create back lot for Robert Trosky, New Boston Road, Map R7, Lot 21-2.

The PB discusses the Trosky application. The PB requires a letter authorizing power of attorney from the applicant prior to accepting the application.

7:55pm The PB discusses proposed changes to the Zoning Ordinances.  The PB discusses the issue of giving the ZBA the authority to hire consultants.  The PB discusses what happens if the applicant comes in to the ZBA with additional information that was not provided previously to the PB.  The ZBA can hire an outside consultant at their own expense. The ZBA is looking to be able to bill the applicant for the fees.  BMarshall states that this whole argument is being driven by language from the LGC to clear up a conflict between two RSA’s.   The PB agrees that this discussion should continue and a decision made at the next meeting.  KO’Connell will provide the PB with the specific language as proposed by the LGC.

8:51pm The PB discusses when the first public hearing should be scheduled.  The PB agrees that all the work can be completed for a public hearing to be scheduled for January 11, 2010 at 8:00pm.

8:55pm The PB discusses Zoning Ordinance Section II Definitions as provided to the PB by the Greenfield CEO.  MSteere points out that in the Building Permit section it discusses ‘structures’ which is defined by the Section II Definitions which is conflict.  The PB resolves the conflict.

9:10pm The PB discusses the proposed Special Use District as a new section in the Zoning Ordinances.  KO’Connell discusses the proposal.  BMarshall would like to bring in the parties that would be covered by the Special Use District and get their opinions in an open forum prior to finalizing this proposal.  The PB agrees to table this item.

9:21pm BMarshall discusses the meeting on Wednesday January 6, 2010 at 6:00pm to discuss the Groundwater Protection Ordinance.  

9:35pm JFletcher moves that the meeting be adjourned,   MBorden seconds, no discussion, all in favor, the meeting is adjourned.
